TERMS AND CONDITIONS FOR PRIVATE CONTRACTS
1. GENERAL CONDITIONS
• All works contain my signature, which you must not remove.
• I can draw your job while live streaming or share the process on the site.
• Prices are subject to change depending on circumstances.
2. PAYMENT
• I accept payments in CZK/EUR/USD/PLN via PayPal or via bank account.
• Orders to pay 100% of the amount in advance.
• Please do not send me any payments until we have agreed and agreed on the slot together and I have accepted your order.
Donation payment on Twitch is not possible!
3. PROCESS & DELIVERY
• When I am working on your order, I will make revisions to meet your wishes in the best possible way.
• During the revisions, I will send you the work in progress and these files will be of lower quality than the final work.
• The processing time of the order can vary, but it is most often from 1 week to 2-3 months. Over 1 month it is usually only for unexpected reasons such as illness, school, family matters, or art block.
• Once the work is complete, you will receive a full-resolution image along with a version that is suitable for sharing on the Internet.
If you want a copy from me, I will process it for you for an additional fee and send it to you by appointment.
4. REVISION
• Revisions are free, but if you want to change something after the changes from the final revision, when we have already agreed on the finished work, it will be for a fee.
This fee is not payable if I have misunderstood something from your request or have forgotten something.
5. COPYRIGHT/NO-TALK POLICY
• I, Klára Vejsová (artist), own the rights to the final work, not the buyer. Therefore, I am allowed to use this product for the following:
○ Promote myself with this product wherever I want
○ Create your own products (bookmarks, prints, postcards, mercantile...) using this work
○ Share this work wherever I want (social media, website, portfolio, etc.)
• The buyer has the right to:
○ Use this work for personal use - i.e. share on social networks, upload to the web, etc.
○ Print the work and claim the character as your own, unless it is fanart, but you must not claim the work as your own.
○ Use this work for self-promotion (see signature!) or mark up on a post.
○ Use this work on your YouTube/Twitch and other for-profit sites, unless the work is the main source of income.
• Copyright infringement includes:
○ Reproduction/use of a copyrighted work of art - i.e. to make money from it in any way.
○ Claim artwork as your own
○ Remove a signature from a drawing
○ Changing artwork without my consent
SKETCH ORDER:
The sketch I provide for you must not be completed by another artist, it is contrary to my artistic identity.
5.1 COPYRIGHT / POLICY OF USE BY PRIOR ARRANGEMENT
If you want to use a work of art for your merch or other design, product, or in any other way to MAKE MONEY on the part - in this case you have to let me know BEFORE the start of the order and we will make arrangements.
6. REFUND/REFUND/ORDER CANCELLATION
REFUND
• The buyer has the right to a full refund only if I am unable to complete the order for some reason, or if I cannot fulfil the customer's initial wishes, or if I no longer want to process the order. In this case, I will refund the full amount to the buyer.
• The buyer has the right to decide to cancel the order only before I start processing the colors, in the case of a sketch this option does not exist. After cancellation, I refund a maximum of half of the amount paid, depending on the time spent on the artwork. I will let the buyer know the process of my orders in advance.
• If you have requested a refund and you are entitled to it at the time, please do not request it through PayPal, I will refund your money via your bank account.
• If you request a PayPal refund at any time when you were not entitled to do so under the above statements, you forfeit all such rights to that work and I will have full right to that work and will be able to do with it as I wish.
On PayPal, I will refuse your request for a refund and will provide PayPal with information about my rights written in these Terms and Conditions, as well as conversations and arrangements with your consent. If you do so repeatedly, you will be blacklisted, i.e. you will no longer have the right to request another contract.
If the buyer violates any of the rights mentioned above, he will lose all of the above rights to the work ordered from me, Klára Vejsová (the artist), and I will have every right to continue to make money from the ordered work as I wish. If you have a problem with any of these statements, please do not place an order.
What do you get?
• Proposals/drawings from which you have to choose what to proceed with, there are usually 4-8 proposals.
• Sketches and/or final sketches that you must accept before I can continue working.
• Consultation and joint agreement on the color plan.
• A full resolution file (approx. 500x400mm at 300 DPI) of the final drawing and a smaller version for internet upload (72DPI). The final file formats are usually PNG. I can also supply PDF or JPEG if you wish.
In the case of emoticons, the same rights apply, only the size of the files you get changes, I will send you the emoticons on Twitch in the sizes you want. The basic size you always get is 800x800px, 300DPI
