CONTRACT TERMS FOR PRIVATE ORDERS
1. GENERAL CONDITIONS
• All works contain my signature, which you may not remove.
• I can draw your order during the live broadcast or share the process elsewhere, unless we agree otherwise (e.g. orders that will be a gift, etc.).
• Prices may change depending on circumstances.
2. PAYMENT
• I accept payments in CZK/EUR/USD/PLN via PayPal primarily, or through a bank account.
• Orders can be paid either 100% of the amount in advance.
• Please do not send me any payments until we have agreed and agreed on the slot together and I have accepted your order.
Payment by donations on Twitch is not possible!
3. PROCESS AND DELIVERY
• When I work on your order, I will make revisions to meet your wishes as best as possible. (more on point 4)
• During revisions, I will send you work in progress and these files will be of lower quality than the final work.
• The order processing time may vary, but is most often from 1 week to 2 months. More than 1 month is usually only due to unexpected reasons such as illness, family matters, or art block.
• Once the work is complete, you will receive a full resolution image along with a version that is suitable for sharing on the Internet. I DO NOT SEND physical copies, but of course you can print the work yourself in many copyshops, etc. (more on point 5). If you want a copy from me, I will process it for an additional fee and send it by arrangement.
4. REVISION
• Revisions are free, but if you want to change something after the changes from the final revision, when we have already agreed on the finished work, it will be for a fee. This fee isit does not apply if I misunderstood something from your request or if I forgot something.
5. COPYRIGHT / POLICY OF USE WITHOUT PRIOR AGREEMENT
• I, Klára Vejsová (artist), own the rights to the final work, not the buyer. Therefore, I am allowed to use this product for the following:
○ Promote this product wherever I want
○ Create your own products using this work
○ Share this work wherever I want (social networks, website, portfolio, etc.)
• The buyer has the right to:
○ Use this work for personal use - ie. share on social networks, upload to the web, etc.
○ Print the work and claim the character as your own if it is not fanart, but may not claim the work as your own.
○ Use this work for your own promotion (you do not have to indicate the author of the work in any way, apart from the already included signature, but I would be very happy).
○ Use this work on your Youtube/Twitch and other monetization sites, as long as this work is not the main object of monetization._d04a07d8-9cd1-3239-9149-6c73b_2081
• Copyright infringement is considered to be:
○ Reproduction/use of copyrighted artwork - ie. make money from it in any way.
○ Claiming a drawing as your own
○ Removing a signature from a drawing
○ Changing the drawing without my consent
SKETCH ORDER:
The sketch I provide for you must not be completed by another artist, it is against my artistic identity.
5.1 COPYRIGHT / POLICY OF USE WITH PRIOR AGREEMENT
If you want to use the artwork for your merch or other design, product, or in any other way to EARN on the work - in this case you have to let me know BEFORE the order STARTS and we will make an agreement.
6. REFUND / REFUND / ORDER CANCELLATION
MONEY BACK
• The buyer has the right to a refund of the entire amount only if I cannot complete the order for some reason, or I cannot fulfill the customer's initial wishes, or I no longer want to process the order. In that case, I will refund the buyer in full.
• The buyer has the right to decide to cancel the order only before I start the color processing, in the case of a sketch this option does not exist. After cancellation, I return a maximum of half of the amount paid, according to the time spent on the artwork. I will let the buyer know the process of my orders in advance.
• If you have requested a refund and you are entitled to it at that moment, please do not request it via Paypal, I will refund you myself.
• If you request a refund from PayPal at any time when you did not have the right to do so according to the statements above, you will lose all such rights to this work and I will have full rights to this work and will be able to do with it as I wish. I will reject your request for a refund on PayPal and I will supply PayPal with information about my rights as set out in these terms and conditions, as well as our conversations and agreement and your consent. Furthermore, you will be blacklisted forever, ie. you will no longer have the right to request another order.
If the buyer violates any of the rights mentioned above, they will lose all the above-mentioned rights to the given work ordered from me, Klára Vejsová (artist), and I will have full right to continue to make money from the ordered work as I wish. If you have a problem with any of these statements, please do not place an order.
What do you get?
• Designs/drawings from which you have to choose what to proceed with (there may be fewer or more designs depending on the complexity of the work).
• Sketches and/or final sketches that you must accept before I proceed with the work.
• Inspection and joint agreement regarding the color plan (depending on the complexity of the ordered work).
• Full resolution file (approx. 500x400mm at 300 DPI) of final drawing and smaller version for internet upload (72DPI). Final file formats are usually PNG. I can also provide PDF or JPEG if you wish.
In the case of emoticons, the same rights apply, only the size of the files you receive changes, I will send you the emoticons on Twitch in the sizes you wish. The basic size you always get is 800x800px, 300DPI
